1What Pandy does — and what it does not
Pandy estimates the nutritional value of a meal from a photo, and calculates a daily calorie target from the information you provide. The app also offers weight, hydration and intermittent fasting tracking.
Pandy is a wellness app. It is not a medical device within the meaning of European Regulation 2017/745. It is not intended for the diagnosis, prevention, treatment or monitoring of any disease or condition. None of its features pursues a medical purpose.
Do not use Pandy to manage a treatment or a medically prescribed diet. If you are diabetic, allergic, have kidney failure, are on a prescribed diet, or need to count a nutrient precisely for health reasons, these estimates are unsuitable and may be dangerous. Rely on official labelling and on your healthcare professional.
Consult a professional before changing your diet if you have a medical condition, are pregnant, are breastfeeding, or are on long-term treatment.
2Minimum age
Pandy is restricted to people aged 18 or over. By creating an account, you declare that you are at least 18.
This limit is not administrative. Calorie tracking and dietary restriction in a growing person call for medical supervision, not an app. If we find that an account belongs to someone younger, we delete it along with the associated data.
3Eating disorders
Pandy is not intended for people suffering, or having suffered, from an eating disorder — anorexia, bulimia, binge eating, orthorexia. Calorie counting, numerical targets and tracking streaks can sustain or worsen these conditions.
Monday to Friday, standard rate call.
We reserve the right to suspend an account where observed usage appears manifestly incompatible with the person's health.
4Built-in safeguards
Pandy applies safety limits to the targets it calculates: a minimum calorie floor, a deficit capped as a proportion of estimated energy expenditure, and a maximum rate of weight loss. These bounds cannot be overridden from within the app.
They are not a guarantee of safety for your particular situation: only a professional can assess that.
5Pandy Pro subscription
Access to the features requires a subscription, offered in two plans:

These prices apply to France and vary by country. The exact price, in your currency, is shown to you before any confirmation.
6Free trial
The yearly plan includes 3 free days, reserved for new subscribers and usable once. At the end of the trial, the subscription is billed automatically, unless cancelled at least 24 hours before it ends.
7Renewal and cancellation
Subscriptions renew automatically. The amount is charged to your Apple account on confirmation of purchase, then at each renewal, unless cancelled at least 24 hours before the end of the current period.
How to cancel
On your iPhone: Settings → your name → Subscriptions → Pandy Pro → Cancel Subscription.
Cancellation takes effect at the end of the period already paid for: you keep access until then. Deleting the app does not end the subscription.
8Right of withdrawal
As the service is supplied immediately after purchase, you expressly waive your fourteen-day right of withdrawal at the moment you confirm your subscription, in accordance with Article L221-28 of the French Consumer Code.
This waiver does not deprive you of any right relating to a malfunction of the service.
9Refunds
Payments are collected by Apple, which alone handles refunds. Requests are made at reportaproblem.apple.com. The publisher has no technical means of refunding a purchase made through the App Store.
10Acceptable use
You undertake not to:
- circumvent usage limits or security mechanisms;
- automate use of the app or of its analysis service;
- share your account with third parties;
- use the app on behalf of a person under 18;
- transmit unlawful content or content infringing the rights of others.
11Accuracy and availability
The analysis relies on an artificial intelligence model. It is approximate by nature: the exact nature of the food, how it was prepared, added fats and actual quantities cannot be measured from a photograph. No accuracy is guaranteed, and deviations from real values may be significant.
The analysis requires an internet connection and depends on third-party providers. The service is provided as is, without guarantee of continuity. We may change, suspend or withdraw features, informing you if the change is significant.
12Intellectual property
The app, its name and its original content are protected. Any reproduction without written authorisation is prohibited.
Certain graphic elements and animations are used under licence from their respective authors and remain their property.
The photos you take remain your property and are not exploited.
13Liability
You use Pandy at your own risk. The publisher cannot be held liable for the consequences of dietary choices, restrictions or health decisions based on the estimates provided, nor for deviations between those estimates and real values.
You remain solely responsible for your diet, your health, and for consulting a professional where your situation warrants it.
These limitations apply to the extent permitted by law. They do not apply in cases of gross negligence or wilful misconduct, nor against rights that the law grants consumers on a mandatory basis.
14Suspension of access
We may suspend or terminate your access in the event of a breach of these terms, abusive use of the service, or where the safety of the person or of the service requires it. Amounts corresponding to a period already paid for and not supplied will be refunded to you through Apple.
15Personal data
You can delete your account at any time from Settings → Delete my account. This deletion is immediate and permanent: it erases your account, your analysis history and your local and iCloud data. It does not cancel your subscription, which is managed from your iPhone settings.

16Mediation
In the event of a dispute, you may use a consumer mediator free of charge, or the European online dispute resolution platform: ec.europa.eu/consumers/odr.
17Governing law
These terms are governed by French law. Failing an amicable settlement, the French courts have jurisdiction, without prejudice to the protective rules applicable to consumers.
